Commercial License Agreement
1. Parties
This Commercial License Agreement (“Agreement”) is between CapitalOfMystery.com (“Licensor”) and the individual or legal entity that purchases or otherwise lawfully acquires the digital party-kit files (“Licensee”).
2. Definitions
Product – All PDF files, images, scripts, and related digital assets included in the Murder on the Moonlit Atlantic download package.
Event – A single murder-mystery performance, party, classroom session, fundraiser, or similar gathering at one venue over one calendar day.
Printout – A hard-copy or digital projection of any portion of the Product used solely to facilitate an Event.
3. Grant of License
Licensor grants Licensee a non-exclusive, non-transferable, worldwide license to:
Download and store the Product on up to three (3) devices owned or controlled by the Licensee;
Reproduce the Product, in whole or in part, as Printouts strictly for the number of participants at each Event;
Host, perform, or otherwise present the Event for private, educational, or commercial purposes, including charging admission or collecting fees.
4. Permitted Uses
Unlimited personal or corporate Events run by the Licensee.
Marketing materials (flyers, social posts) that use up to three (3) low-resolution images from the Product solely to advertise Licensee-hosted Events, provided the Product title and © notice remain visible.
Minor cosmetic edits (logo placement, font substitution) that do not alter narrative content or jeopardize the authorship credit.
5. Prohibited Uses
Licensee shall not:
Sell, sublicense, upload, or distribute the Product or substantial portions of it in raw or editable form;
Offer the Product as part of a digital download bundle, subscription, or template library;
Remove or obscure the copyright notice, branding, or author credits;
Translate, adapt, or create derivative works intended for separate sale or distribution without prior written consent;
Use the Product in any manner that is defamatory, unlawful, or violates applicable regulations.
6. Ownership & Intellectual Property
All rights, title, and interest in the Product remain the sole property of the Licensor. No intellectual-property rights are transferred except the limited license expressly stated herein.
7. Term & Termination
This Agreement is effective on the date the Product is first delivered to the Licensee and continues indefinitely unless terminated. Licensor may terminate the license if Licensee breaches any term; upon termination, Licensee must delete all digital copies and destroy Printouts.
8. Updates
Licensor may issue optional revisions or errata. Obtaining updates does not extend or amend this Agreement.
9. Credits & Attribution
When publicly promoting an Event, Licensee must display the game title and credit line:

10. Warranty Disclaimer
The Product is provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Licensee assumes all risk arising from its use.
11. Limitation of Liability
To the fullest extent permitted by law, Licensor’s aggregate liability shall not exceed the license fee actually paid. Licensor shall not be liable for indirect, incidental, or consequential damages.
12. Entire Agreement
This document constitutes the complete understanding between the parties and supersedes all prior proposals or agreements, oral or written, regarding the Product. Amendments must be in writing and signed by both parties.
